General Terms

Verve Pilates Ltd (referred to as Verve Pilates) operates as a reformer Pilates studio in Portishead, United Kingdom. Please read these Terms and Conditions (the ‘Terms’) carefully, as it is a condition of us allowing you to use our studios, that you agree to our terms and conditions.

  1. By registering yourself or your child to attend a class with Verve Pilates, obtaining a Membership, Class Pack or otherwise physically entering a Verve Pilates studio, this signifies that you have read, understood and agree to be bound by the Terms & Conditions and have signed the associated waivers. If you do not agree with these Terms, you must cease usage of any of our services, immediately. Verve Pilates reserves the right to review and change any of the Terms by updating this page at its sole discretion. These Terms apply to all users of our Studio, unless stated otherwise.
  2. All clients in attendance at Verve Pilates must follow our Studio rules as stated below:
    • Comply with all Studio health and safety requirements, as amended from time to time.
    • Comply with any relevant laws.
    • Respect other Verve Pilates members, package users, our Representatives, including not causing offence or injury to those people or causing damage to their property.
    • Wear suitable fitness clothing when participating.
    • Enter and leave the Studio without making unreasonable levels of noise or disruption.
    • Arrive for class in a timely manner, late arrivals will not be permitted to attend.
    • Cease Participating and notify the instructor in the event of injury, discomfort or illness.
    • Not allow third parties, who are not members, session package users or guests, to access the Studio.
    • Comply with our trainers instructions at all times.
  3. We reserve the right to restrict or terminate your access and permission to use our Studio, in specific circumstances, such as if you breach these terms and conditions.
  4. Participating in any form of exercise at Verve Pilates is done entirely at your own risk. Members are advised to seek medical advice prior to commencing any exercise program if they are in any doubt about their ability to engage in exercise. You or your parent/guardian in the case of a participant being under the age of 18, expressly waive and release any claim that you may have at any time for injury of any kind against Verve Pilates, or any person or entity involved with Verve Pilates, including without limitation its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.
  5. Verve Pilates will make every possible effort to deliver classes and services on time as advertised. However, there may be times when a scheduled class is unable to be delivered. Verve Pilates reserves the right to make changes to the class schedules, opening hours and instructors at any time. Verve Pilates will make reasonable efforts to notify clients of any changes.
  6. For the safety of all clients, Late entry is not permitted to any class. Please ensure that you arrive 5-10 mins before the scheduled class time at a studio. If you arrive when the hamstring stretch portion of the warm up is complete, you will not be permitted to join the class. Our trainers, directors and contractors reserve the right to refuse entry if we deem it unsafe to you or other clients.
  7. Verve Pilates will not be responsible for the safekeeping of clients belongings while they are at the studio. We recommend that you only bring personal belongings into our Studio which are absolutely necessary for you to possess for the duration of your visit. Clients are not permitted to interfere or tamper with, steal, or cause loss or damage to, the personal belongings of another person at the Studio. If a Client is found to be breaking this term, we may cancel your Membership and permanently ban them from entering our Studio.
  8. Age Limits: Clients between the age of 14 years and 16 years can attend as long as a parent or guardian consents and accompanies them at each class. The parent or guardian must sign the waiver form for the child, to acknowledge the activity you and your child are participating in and any inherent risks involved. Where you are responsible for such children you agree to be bound by these conditions on their behalf and you will directly supervise them at all times. For the comfort and safety of all participants, children under the age of 14 are not permitted in the studio and may not wait in the studio or waiting room while their parents are attending a class.
  9. To the extent permitted by law:
    • Verve Pilates and its Representatives will not be liable and excludes all liability under these Terms and Conditions, in tort, statute or in any other way for all injury, illness, damage or loss of any kind whatsoever directly or indirectly sustained by you in relation to a Membership, participating in any Class or otherwise entering the Studio.
    • You hereby release Verve Pilates and its Representatives from all claims relating to a Membership, participating in any Class or from otherwise entering the Studio.
  10. In the event that Clause 10 is not enforceable for any reason, then our maximum aggregate liability arising from or relating to any claim by you, however arising, shall not exceed the membership fees paid by you to Verve Pilates during the past 12 months.
  11. You hereby indemnify Verve Pilates, and its Representatives, from all direct, reasonable and quantifiable loss or damage suffered by Verve Pilates and/or its Representatives as a result of you breaching these Terms and Conditions.

Studio Safety and Client Wellbeing

Verve Pilates are committed to ensuring the health and wellbeing of all of our clients. You are required to inform Verve Pilates and our instructors of any health risks, pre-existing injuries, illness, pregnancy, a medical condition or anything that may affect your exercise practice before attending a class. Where you have a medical condition that may impact your movement, we strongly recommend that you seek approval from a medical practitioner to participate in any of our Classes. Participating in any form of exercise at Verve Pilates with a Medical Condition is done entirely at the clients own risk.

Physical exercise, in all of its forms and with or without the use of equipment such as dumbbells, balls, rings or any other equipment that may be suggested by a Verve Pilates instructor, is a strenuous physical activity. Accordingly, all clients are urged and advised to seek the advice of a physician before beginning any new physical exercise regimen, routine, program or using any suggested equipment. Verve Pilates is not a medical organization and its instructors or staff cannot and will not give you medical advice or diagnosis. All suggestions and guidance relating to the use of equipment, exercises and instruction are not required to be performed by you and are carried out at your own discretion while attending class.

By using the Verve Pilates App or Website to book a class, you acknowledge that you understand that physical exercise with Verve Pilates involves strenuous physical movement and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. All clients must ensure that by participating in classes and activities from Verve Pilates, you will not exceed your limits while performing such activities, and you will select the appropriate level of classes for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that instructors may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.

Booking and Cancellation Policy

All sessions must be booked using the Verve Pilates app or the Verve Pilates online booking system (powered by ABC Glofox), prior to arriving at the studio.

If you have booked to attend a class and wish to cancel your attendance, you must process a cancellation up to 8 hours prior to the scheduled commencement time for the class. Verve Pilates will not accept cancellations by phone, e-mail or any other method other than by using the Verve Pilates app or online booking system.

Any cancellations processed less than 8 hours prior to the scheduled class start time will be considered a Late Cancel and will be subject to cancellation fees or loss of class credit. If you do not cancel your class and you do not attend, you will be considered a No Show. This includes classes that you have joined in to from the waitlist.

Clients on a Foundation Membership with unlimited credits will be charged a nonrefundable £5 Late Cancel Fee and a £8 No Show Fee.

8,10 or 12 per month Members, Class Pack holders and Casual Class clients will be charged a £5 No Show Fee. Class credits will also be forfeited if you No Show or Late Cancel the booked class outside the free cancellation period.

Cancellation fees will be applied within 24 hours of the scheduled class. By booking online you are agreeing to the late cancellation and no show policy.

Payment, Returns & Refunds

Verve Pilates may change the auto-pay (“direct debit”) terms and/or pricing at any time by providing the client with 30 days written notice of such changes.

Verve Pilates is in no way responsible for additional fees that a holder may incur from their bank in relation to processing payment of fees for direct debit Memberships.

All purchases are final, and direct debit transactions are non-exchangeable, non-refundable or non-transferable. Verve Pilates is not liable to refund, transfer or offer compensation of any kind for classes that are unused, changed or cancelled for any reason (e.g. sickness, travel etc), or in the event you are unable to attend a class because it is full.

Memberships and class passes are not refundable or transferable unless otherwise agreed by Verve Pilates in writing.

Verve Pilates does not take cash payments, all payments must go through the clients account via the Verve Pilates App or online store.

Gift cards are not redeemable for cash.

Introductory Packages ‘Verve Intro’

The Introductory package ‘Verve Intro’ may only be purchased by new clients who have not yet attended a class at Verve Pilates. Introductory Offer packages are valid for 15 days, from your first class attendance and must be activated within 3 months of sign up. No refunds, transfers, suspensions or extensions are offered on unused portions of any Introductory Offer unless due to illness or injury, when a medical certificate is provided. Verve Pilates reserves the right to cancel Introductory Offer packages for clients signing up under another alias, additional email address or falsifying identity. We may refuse use of the studio and no refund will be made.

If a Promotional Code is provided to an individual or business, enabling the individual/employees to receive a discounted or complimentary ‘Verve Intro’ the code must not be shared with persons outside that organisation. Verve Pilates reserves the right to cancel a complimentary or discounted Introductory packages if they believe the client is not entitled to specific discount codes.

Foundation Memberships

Foundation Memberships (unlimited classes) purchased during a studio opening promotional period are subject to the following terms and conditions:

Class/Month Auto Pay Memberships

Membership Agreements

When signing up to a Verve Pilates Membership, you must accept the membership agreement detailed on the Verve Pilates app or online registration. Accepting this agreement authorises the direct debit and agrees to any conditions specific to your Membership package.

Membership Periods

If you are a Verve Pilates 8 class/month, 10 class/month or 12 class/month member, you are welcome to join the number of classes per your membership, in any given week of the month. Your ‘month’ begins on the day of your billing cycle. For example, if you pay on the 5th day of the month, you will have until the 5th of the next month to use all 8 classes. Please note that any unused classes do not roll over to the next month.

Membership Upgrade/Downgrade

We understand that life and commitments can change, Verve Pilates Members are welcome to increase or decrease membership packages after the initial 3 month commitment period. Simply email hello@vervepilates.uk to request changes to your Membership. Changes made will be effective from your next scheduled direct debit.

Suspend Your Membership

Life can get busy, for this reason, you are welcome to pause your Verve Pilates membership at any time, for up to 2 months. Foundation memberships are not eligible for suspensions for any reason.

If you would like to suspend your membership, simply request your suspension by emailing us at least 1 week prior to your next scheduled direct debit payment.

Terminate Your Membership

All memberships have a minimum commitment period, after which time Clients may terminate their membership without fees. To terminate your membership please email hello@vervepilates.uk. Terminations require a 30 day notice period from your next scheduled direct debit payment. All requests for terminations must be made in writing, in-studio or verbal cancellations will not be accepted. You will receive an email confirming your cancellation when we have processed your request. Please note, if you do not receive an email confirmation within 48 hours, your cancellation request has not been received.

Memberships are paid a month in advance and no refunds can be offered once the transaction has been made if you fail to advise within the notice period.

We understand that life can be unexpected, so please discuss your situation with us directly if required.

Class Packs

Class Packs are non-transferable and must not be sold, traded, shared or otherwise transferred to any other person. If we discover that you are engaging in any of these activities, we reserve the right to cancel your Class pack permanently and ban you from visiting our Studio.

Annual

Annual class packs expire in 12 months from the purchase date. No refunds, transfers, suspensions or extensions are offered on unused portions of the Class Packs unless due to illness, injury, which requires presentation of a medical certificate. We reserve the right to refuse extensions or refunds when deemed unnecessary.

Monthly

Monthly class packs expire in 1 month from the purchase date. No refunds, transfers, suspensions or extensions are offered on unused portions of the Class Packs unless due to illness, injury, which requires presentation of a medical certificate. We reserve the right to refuse extensions or refunds when deemed unnecessary.

Private Classes

Private Class bookings are not confirmed until payment is received.

Notice of cancellation must be in writing and provided to Verve Pilates 24 hours prior to scheduled class time. Refunds will not be issued if the correct notice is not given. Cancellations must be made via email to hello@vervepilates.uk

Pre and Post Natal Clients

Firstly, congratulations! We understand how important it is to continue to move your body when you’re growing another. We appreciate that you are considering Verve Pilates at this time in your life. The benefits of a well structured, well rounded exercise program during pregnancy can be beneficial for both mum and baby.

Please note that practicing is at your own risk and it is your responsibility to practice the modifications with caution. Doctors approval is required for all high-risk pregnancies, prior to commencing any classes with Verve Pilates. Clients must ensure the Trainer is informed what week you are up to at the beginning of each class, as modifications of certain exercises will need to be given.

Every mother’s postpartum experience is unique so please listen to your body and only return when you feel safe and comfortable to do so. After your 6 week check up with your GP or Obstetrician post giving birth, as long as you have clearance, you can begin to ease yourself back into foundation classes.

We recommend starting with our Mums and Bubs classes before returning to foundation classes where trainers will provide modifications as required. Non crawling babies are welcome to Mums & Bubs classes only, for the safety of you and your tiny human. Don’t worry if you need to stop during class to feed or change them, any movement is good movement in Postpartum. Babies must be in a bassinet, carrier or safely placed on a blanket away from reformer beds. Verve Pilates and our trainers are not responsible for the safety of your child around equipment when they are in the studio.
